Getting Married in New York State

New York Matrimonial and Family Law Attorney

Getting married in New York state is very much an agreement: Among other things, you make a promise to honor and love each other. You promise to be faithful and do the best you can to nurture and preserve your relationship.

Getting married in New York state is relatively straightforward:

  • Apply for a New York marriage license in person with a clerk of any city in New York. No exam or blood test is required, just the relatively modest fee of (at the time of writing) $40.
  • Provide proof of identity and your age (you must be at least 18 years old if you are getting married in New York state without the consent of your parents). A driver's license or passport, as well as your birth certificate, is sufficient.
  • The marriage ceremony - in which you state that you take each other as husband and wife, typically in front of a priest or judge, as well as the required third-party witness - must be conducted within 60 days of the marriage license being issued.

But, like business contracts that for one reason or another go unfulfilled, some agreements won't work out.

Are You Considering Divorce or Separation?

Your New York state marriage certificate is valid only up to the point that a judge signs off on your divorce. Family law is one of the most difficult areas of law - not necessarily because divorce and family law itself is complicated, and it often is - but because emotions often run high and it can be difficult to think objectively.

That's where an experienced family law attorney can help. If you have a prenuptial agreement in place or you are thinking about getting married in New York state, such an agreement can significantly reduce conflict regarding property, assets and debt. A prenup - and a lawyer to help you think through these issues - can go a long way toward reducing stress, whether or not you get divorced.
